The legal action, initiated by Hagens Berman Sobol Shapiro LLP, covers investors who acquired Regeneron common stock between August 1, 2025, and May 15, 2026. The complaint alleges that the company misled shareholders by promoting the combination of Fianlimab and Libtayo as a potential blockbuster, despite internal knowledge that the study’s statistical assumptions were flawed and the treatment was failing to differentiate itself from standard therapies.

Management repeatedly characterized the slowing rate of disease progression events as a sign of the drug's efficacy. However, the litigation asserts that these delays were actually indicative of the trial's underlying failure. On April 29, 2026, the company disclosed a protocol change intended to extend patient follow-up periods, a move analysts immediately suspected was a response to insufficient progression-free survival benefits. By May 15, 2026, Regeneron confirmed that the trial had failed to reach statistical significance, leading to a sharp decline in share price. Reed Kathrein, a partner at Hagens Berman, stated the investigation is focused on whether the firm intentionally withheld the protocol alterations to prevent investors from realizing the treatment lacked commercial viability.
